Digster is a music discovery platform that helps users find similar tracks and artists. The Service uses audio analysis and recommendation algorithms to suggest music based on user searches.
MVP Notice: This Service is currently operating as a Minimum Viable Product (MVP) for market validation purposes. During this period, we may test pricing, features, and user experience. We reserve the right to modify or discontinue the Service during the validation period.
You may use the Service without an account with limited search credits. We use browser fingerprinting to track usage and prevent abuse.
To access premium features, you must create an account via OAuth authentication. You are responsible for:
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.
Anonymous users receive limited free search credits. Registered users may receive additional free credits upon account creation.
Premium subscriptions provide additional search credits and features. Subscription details, pricing, and billing terms are available on our Pricing page.
MVP Validation Period: As part of our validation process, we may offer full refunds to early users upon request. After the validation period ends, refunds will be subject to our standard policy (14-day cancellation right per German law for consumer contracts).
You may cancel your subscription at any time. Credits and access remain valid until the end of the billing period.

The Service, including its design, code, algorithms, and branding, is owned by Softwerk GbR and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without written permission.
You retain ownership of playlists and data you create. By using the Service, you grant us a license to store and process this data to provide the Service.
Music metadata, album artwork, and video content are provided by third parties (YouTube, music databases). All rights belong to their respective owners. We do not host or distribute copyrighted music files.
The Service uses the YouTube API to provide video playback. By using this feature, you agree to be bound by the YouTube Terms of Service:https://www.youtube.com/t/terms

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance or updates at any time.
Music recommendations are generated algorithmically. We do not guarantee the accuracy, relevance, or quality of recommendations. Your use of recommendations is at your own discretion.
To the maximum extent permitted by German law, Softwerk GbR shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the last 12 months.
Note: German consumer protection laws (BGB) may provide additional rights that cannot be excluded or limited.
If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason (§ 355 BGB).

Early Performance Consent: If you use paid credits or features during the withdrawal period, you expressly consent to early performance and acknowledge that your withdrawal right expires once the service is fully performed.
Your use of the Service is subject to our Privacy Policy, which complies with GDPR and German data protection laws (BDSG). Please review our Privacy Policy to understand how we collect and process your data.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.
If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription for a pro-rata refund.
Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For disputes with consumers, the place of jurisdiction is the consumer's place of residence. For disputes with businesses, the exclusive place of jurisdiction is Mainz, Germany.

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we will consider reasonable requests for alternative dispute resolution.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.
